Talki Terms of Service

1. Eligibility

You must be at least 13 years old to use Talki.

If you are under the age required by the laws of your country to consent to data processing (for example, under 16 in certain European Union countries), you must have permission from a parent or legal guardian.

By using Talki, you represent that you meet these requirements.

2. Account Registration and Responsibility

To access certain features, you may need to create an account.

You agree to:

• Provide accurate and complete information.
• Keep your account credentials secure.
• Notify us of any unauthorized access.
• Be responsible for all activity under your account.

We are not responsible for losses resulting from unauthorized use of your account.

3. Description of the Service

Talki provides AI-powered language learning features, including but not limited to:

• AI-assisted conversations (roleplay, debate, tutor mode)
• Personalized lesson experiences
• Instant feedback and corrections
• Vocabulary saving tools
• Optional speech and voice functionality

Features may vary by region, device, or technical availability.

We may modify, update, suspend, or discontinue features at any time.

4. Subscriptions and Payments

Some features of Talki require a paid subscription.

Billing

Subscriptions are processed through Apple's App Store. By purchasing a subscription, you agree to Apple's billing terms.

• Subscriptions may renew automatically unless canceled at least 24 hours before the end of the current billing period.
• You can manage or cancel your subscription in your Apple account settings.
• Payments are handled by Apple, not by Talki directly.

Refunds

Refund requests must be made directly through Apple in accordance with Apple's refund policies. Talki does not issue refunds directly.

Price Changes

We may change subscription prices from time to time. Any changes will apply to future billing periods and will not affect your current active subscription term.

5. Acceptable Use

You agree not to:

• Use Talki for unlawful, harmful, abusive, or fraudulent purposes.
• Attempt to access systems, data, or accounts without authorization.
• Interfere with or disrupt the Service or its infrastructure.
• Reverse engineer, scrape, or misuse Talki beyond permitted use.
• Attempt to bypass subscription limits, security systems, or usage protections.

We may suspend or terminate accounts that violate these Terms.

6. Usage Limits and Abuse Prevention

To maintain service reliability, fairness, and security, Talki may apply reasonable limits on usage, including request volume, conversation length, or feature access.

If we reasonably determine that an account is abusing the Service or attempting to circumvent limits, we may restrict functionality, suspend access, or permanently terminate the account.

7. AI and Generated Content

Talki uses artificial intelligence technologies, including third-party services (such as Google/Firebase AI and Microsoft Azure speech services).

AI-generated responses:

• May not always be accurate, complete, or appropriate.
• Should not be relied upon as professional advice.
• May occasionally contain errors.

You are responsible for how you use AI-generated content.

8. Third-Party Services

Talki relies on third-party infrastructure and AI providers. Availability and performance may vary due to factors beyond our control.

We are not responsible for outages, disruptions, or issues caused by third-party providers.

9. User Content

You retain ownership of content you submit (such as conversation inputs).

By using Talki, you grant us a limited, non-exclusive license to process, analyze, and use your content solely to:

• Provide the Service
• Improve functionality
• Maintain security and reliability

10. Intellectual Property

Talki, including its software, branding, design, and original content, is owned by Talki or its licensors and protected by intellectual property laws.

These Terms do not grant you ownership rights in the Service.

You may not copy, modify, distribute, or create derivative works from Talki without permission.

11. Termination

You may stop using Talki at any time and may delete your account within the app.

We may suspend or terminate your access if:

• You violate these Terms
• You misuse the Service
• Required by law

Upon termination, your right to use Talki ends immediately.

12. Disclaimer of Warranties

Talki is provided on an "as is" and "as available" basis.

To the maximum extent permitted by law, we disclaim all warranties, express or implied, including:

• Merchantability
• Fitness for a particular purpose
• Non-infringement
• Uninterrupted or error-free service

13. Limitation of Liability

To the maximum extent permitted by law, Talki will not be liable for:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of data, revenue, or profits
• Service interruptions

In any event, our total liability shall not exceed the amount you paid to Talki in the 12 months preceding the claim.

14. Indemnification

You agree to indemnify and hold harmless Talki from claims, damages, liabilities, and expenses arising from:

• Your misuse of the Service
• Your violation of these Terms
• Your violation of applicable laws

15. Changes to the Service

We may update, modify, suspend, or discontinue features at any time.

We are not liable for any modification or discontinuation of the Service.

16. Changes to These Terms

We may update these Terms periodically. Updated Terms become effective when posted with a revised effective date.

Your continued use of Talki after changes means you accept the updated Terms.

17. Governing Law

These Terms are governed by the laws of Romania, without regard to conflict of law principles.

If you reside in the European Union, you may also have rights under mandatory consumer protection laws in your country of residence.
